General Terms and Conditions (AGB)

Note: No orders can be placed via this website (hock-methode.de). Orders and purchase contracts for printed books are concluded via the online shop at verlagdergesundheit.com; the following terms and conditions apply to purchases made via that online shop. The purchase and provision of digital editions (flipbooks) take place via the external platform FlipHTML5 under its terms. Information on the right of cancellation can be found in our cancellation policy.

General terms and conditions and consumer information for purchase contracts concluded via the online shop between Verlag der Gesundheit (Burkhard Hock) – hereinafter the “Seller” – and the customer – hereinafter the “Customer”.

§ 1 Scope and General Information

(1) Subject to individual arrangements and agreements, which take precedence over these terms and conditions, the following general terms and conditions apply exclusively to the business relationship between the Seller and the Customer. Unless otherwise agreed, the inclusion of the Customer's own terms and conditions is rejected.

(2) The Customer is a consumer insofar as they conclude the contract for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity. In contrast, an entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

§ 2 Conclusion of Contract

(2) The essential characteristics of the goods result from the respective product description provided by the Seller.

(3) All offers in the Seller's online shop merely constitute a non-binding invitation to the Customer to submit a corresponding purchase offer to the Seller. Upon receipt of the Customer's order, the Seller will review it promptly and inform the Customer within 2 working days whether the order is accepted (order confirmation).

§ 3 Subject Matter, Condition, Delivery, Availability of Goods

(1) The subject matter of the contract are the goods and services specified by the Customer in the order and named in the order and/or order confirmation, at the final prices stated in the online shop. Errors and mistakes there are reserved, in particular with regard to the availability of goods.

(2) The condition of the ordered goods results from the product descriptions in the online shop. Images on the website may only represent the products imprecisely.

(3) If no copies of the product selected by the Customer are available at the time of the Customer's order, the Seller shall inform the Customer of this in the order confirmation.

(4) If the product designated by the Customer in the order is only temporarily unavailable, the Seller shall also inform the Customer of this without delay. In the event of a delivery delay of more than two weeks, the Customer has the right to withdraw from the contract.

§ 4 Delivery, Prices, Shipping Costs

(1) Handover to the shipping company takes place within two working days. The delivery time is up to five days.

(2) Delivery takes place within the EU.

(3) All item prices include statutory value added tax. The prices stated are final retail prices including shipping costs.

§ 5 Payment

Payment is processed via PayPal. You can either pay with a PayPal account or select the option to pay by debit or credit card in the PayPal checkout. No PayPal account is required for this.

When purchasing digital books via FlipHTML5, the buyer automatically receives a receipt by e-mail after the purchase (name, title, amount paid in USD). FlipHTML5 does not issue a separate invoice. Business customers who require an invoice are asked to contact office@verlagdergesundheit.com, attaching the receipt.

§ 5a Digital Content and Right of Use

(1) Digital books are intended exclusively for personal use by the buyer. The right of use is non-transferable.

(2) Access data may not be passed on to third parties. The reproduction, making publicly available, passing on or other distribution of the digital content – in particular as a file, printout, screenshot or screen recording – is not permitted without the prior consent of the Seller, unless permitted by law.

§ 6 Transport Damage

(1) If goods are delivered with obvious transport damage, the Customer is asked to report these defects to the delivery agent immediately and to contact the Seller as soon as possible.

(2) Failure to make a complaint or to make contact has no consequences whatsoever for the Customer's statutory warranty rights.

§ 7 Warranty for Defects

(1) The provider is liable for material defects in accordance with the applicable statutory provisions, in particular Sections 434 et seq. of the German Civil Code (BGB).

(2) A guarantee for the goods delivered by the provider exists only if it has been expressly given in the order confirmation for the respective item.

§ 8 Retention of Title

The delivered goods remain the property of the Seller until payment has been made in full.

§ 9 Liability

The statutory provisions apply.

§ 10 Contract Text

The contract text is stored on the Seller's internal systems. The Customer can view the general terms and conditions at any time. The order data and the terms and conditions are sent to the Customer by e-mail.

§ 11 Final Provisions

(1) The contract language is German.

(2) Contracts between the Seller and the Customer are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

(3) If the Customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the Customer and the Seller is the Seller's registered office.

Consumer Dispute Resolution (Section 36 VSBG)

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
